TERMS & CONDITIONS AND PRIVACY POLICY

Please read these terms and conditions ("Terms and Conditions", "Terms") carefully before purchasing any licence and using Cosmetic Companion (known as "the Product") developed by Cosmetic Companion Limited (known as "the Company"). By purchasing the Product you, (known as "the Purchaser"), agree to be bound by these Terms and Conditions of this agreement (known as "the Agreement").

Conditions of use

Before purchasing a licence, or purchasing a copy of the Product outright, you certify that you, the Purchaser, have read and reviewed this Agreement and that you agree to comply with its Terms. If you do not want to be bound by the Terms of the Agreement, you are advised neither to purchase the software outright, nor a licence to use the software. The Company only grants use of the Product to those who accept its Terms & Conditions. Copying of the software to any 3rd party is strictly forbidden. Infringement of this condition may result in legal action to recover any financial loss to the Company of such action.

Recommendation discounts

When the holder of a Cosmetic Companion licence recommends another person to purchase a full Cosmetic Companion licence (excludes the three month trial version), they will receive a 10% discount off their next renewal licence. The licence holder can accrue these discounts up to the maximum of 100% discount. The recommended person must purchase a full licence, in order for the licence holder's account to be credited with the recommendation discount. The licence holder's name must appear in the 'Add a note' field in the shopping cart, when the recommended person purchases their licence. It is the responsibility of the licence holder to ensure that the recommended person is fully aware of this.

Cosmetic Companion Ltd will issue (via email) a coupon for the accrued discount one month before the renewal date of the licence holder's licence.

Partner discounts

The discounts offered by Cosmetic Companion's partners are for use by the licence holder only. Any abuse of the discounts, including but not limited to the passing of discount codes to other people, will result in the licence holder being unable to use any further discount codes for the purchase of Cosmetic Companion's partners' products or services.

The name of the Purchaser is only held to ensure that the software was actually purchased by the Purchaser of the licence in the case of either renewing a licence or in any dispute over ownership of the licence. The address given when initially purchasing of the Product is held for a period of two weeks, to resolve any potential issue over delivery of the software. After two weeks the address information will be purged from the records.

In any event the Company undertakes never to share any personal information of the Purchaser to any 3rd party.

Intellectual property

You agree that all materials and code provided in the Product remain the sole property of the Company and its directors, officers, employees, agents, suppliers, including all copyrights, trade secrets, and other intellectual property. You also agree that you will not reproduce or redistribute the Company's intellectual property in any way, including electronic or digital methods.

Applicable law

By using the Product, you agree that the laws of the United Kingdom, without regard to principles of conflict laws, will govern these Terms and Conditions, or any dispute of any sort that might come between the Company and the Purchaser (including any business partners or associates).

Disputes

Any dispute, between the Company and the Purchaser, related in any way to use of the Product by the Purchaser shall be arbitrated by the judicial system of the United Kingdom, and the Purchaser consents to exclusive jurisdiction and venue of such courts to be decided by the Company.

Indemnification

You agree to indemnify the Company and hold the Company harmless against legal claims and demands that may arise from your use or misuse of the Product. The Company reserves the right to select its own legal counsel.

Limitation on liability

The Company is not liable for any damages that may occur to the Purchaser as a result of misuse of the Product. The Company reserves the right to edit, modify, and change this Agreement at any time. The Agreement is an understanding between the Company and the Purchaser, and supersedes and replaces any and all prior agreements regarding the use of the Product.
